Specifying Interpersonal Responsibilities in Private Law: Property Perspectives

Abstract Recognizing Wrongs reflects an ongoing challenge within private law theory: once ideal of interpersonal responsibility and accountability is recognised at law’s centre, how are these dimensions to be developed in a manner that does not unduly undermine systemic predictability clarity? This article responds this from the perspective property theory. It suggests inspiration as kinds core unifying values could clarify obligational can found varied sources, including Thomistic thinking, with opportunities for identifying developing responsibilities already existing doctrine, example servitudes. As we face urgent sustainability challenges, their strong inter-generational dimensions, argues scholars should think afresh about need moral basis respect property, focus on human sustenance providing one candidate reasoning ownership obligations.
